Changes to these Terms

Indemnity

Dispute resolution

If a dispute arises out of or relates to these Terms, the parties agree to attempt to resolve the dispute in good faith before commencing court proceedings (except where urgent interlocutory relief is sought).

1. A party must give written notice of the dispute, including the nature of the dispute, desired outcome, and action required to settle it.
2. Within 28 days of notice, the parties will endeavour to resolve the dispute by negotiation or other mutually agreed means.
3. If unresolved after 28 days, the parties will agree to a mediator or request an appointment by the Australian Mediation Association.
4. Mediation will be held in Sydney, Australia. The parties are equally liable for mediator fees and venue costs, and each bears its own costs.

Communications made in connection with dispute resolution are confidential and (to the extent possible) treated as without prejudice negotiations under applicable evidence laws.

Venue and jurisdiction

The Website and Services are intended to be viewed and used by residents of Australia. You agree that the courts of New South Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

Governing law

These Terms are governed by the laws of New South Wales, Australia.

Severance

If any part of these Terms is found to be void or unenforceable by a court of competent jurisdiction, that part will be severed and the remainder will continue in force.
